Baltimore City restricts Paintball, Pellet and Airsoft ownership, etc.


This month Baltimore City Council passed a bill to restrict ownership, possession and use of paintball, airsoft and pellet "guns".
Council Bill 06-0318 has passed and is sent to the Mayor.

Read it here in the 3rd reading phase which, although difficult to read in this form is how it will be sent to the Mayor for signature (approval or disapproval).
Note on the bottom of page 1 is a key to stirkeouts, deletes and additions.

Well, if it IS passed it looks like the biggest issue is going to be the individuals age. What county is the OA store? because this bill seems to only apply in Baltimore City, which I think would affect the Rosedale field ( Rosedale is BC right?) If the field has to now id every player to make sure they are 21, that will wipe out probably 50% of the customer base.

SO, I guess the question would be.. what can we do about it? Do we need to start a petition?

One other thing we can do is a little prevention. What I mean is we need to pay better attention to our behavior off the field when it comes to paintball. If you are not at the field and you are about to fire your marker, take a second to think about what you are about to do, or shoot at and maybe even ask yourself if you would be doing that if the local law enforcement agency was standing right next to you. This bill that is about to be passed is most likely a result of Cause and Effect. What do you think happened to cause this bill? Probably careless use of paintball equipment. So we all have a responsiblility to ourselves, and to each other to do our part off the field as well. Lets not give them a reason to ban the sport.

Since I live in the city, does this mean I have to start sneaking my markers in and out of my truck in the middle of the night?

Rosedale is on Baltimore County.

The new law will be in the City, if the mayor signs it. Why wouldn't she?

I hesitate interpreting it but I think it simply restricts (or raises) the possession & purchase age. One should take the time to read the Article of law that this goes with.

I don't think - if I am understanding it - that it is a bad thing as it sits.

Prevention is certainly the best action to take. Don't give our elected officials any reason to do anything that adversely effects our sport.

Well, the article says that it will be unlawfull to sell, give, lend, or rent a paintball or air pellet gun to a minor under the age of 21. So if this is the case, you would have to be 21 to play at the rosedale field then right?

Rosedale is outside of city limits, and therefore not affected by this law.

I also wouldn't expect the police to be raiding a properly run pball field looking for minors, I think the wording is more intended to make adults responsible for their kids that are using the pellet/paintball guns inappropriately.

Howard County has a similar law already on the books

I am not sure of that, my interpretation of the section on possession, use and discharge says that no one can posses or use a paintball or pellet gun inside Baltimore City limits unless it is being done so in the owners home (and not taken outside) or at an approved indoor/outdoor range for the sole use of teaching the proper use and care of a fire arm. I do not think running around a field, or in your back yard for those you play outlaw, shooting at other people would qualify as teaching the use and care of a paintball/pellet gun at an approved range. Playing paintball in our mind would be teaching the use of the marker but I bet in the eyes of the law it would not. First a paintball field I would not think would be considered a range in the sense of a gun range and second you are shooting people not paper targets.

Don't get me wrong, I own real guns and paintball markers, obviously, and I am not one of those people who think it is the government trying to take away our right to bear arms. I agree that this is not a bad thing, there needs to be laws to keep stupid people from doing stupid things (shooting cars, trees, signs, animals etc. and keeping them out of the hands of irresponsible kids and even some adults). I would just like to see the wording about possession and use done a little differently. Maybe say that they may be used at approved paintball fields and facilities while participating in the act of playing paintball.

I am not aware of any paintball facilities in the city so this will not affect me but it could always spread to Baltimore County, Anne Arundel County, and PG County and on.

I agree with everyone above, people are irresponsible (just look at me) and this is a good thing because there is no good place to play in Baltimore, so accordingly there should be no paintball period in Baltimore, but I can't help the irony that some army recruiter can get a kid out of Baltimore into Iraq shooting people at 18 when this bill limits paintball to 21+. And call me crazy, but aren't there more pressing problems like real guns and such that we should be legislating about rather than this stuff?
